Generally, in North Carolina, an attorney is compensated in one
of two ways for estate administration services:
1. an attorney may assume the role of executor wherein the
named executor in the will renounces his or her right; in this case,
then payment would be in the form of executor fees.
2. an attorney may be hired to assist the executor in
fulfilling the executor's duties; in this case, payment is based on
a reasonable hourly fee depending on the complexity of the
estate.
The estates division typically must approve attorney
fees.
